We shall provide you with information on the Website or other such tools as may be used from time to time (including email) to assist you to make contact with third parties such as horse owners seeking a carer for their animal/s while away from the said property ("Horse Owners") or persons offering services of caring for the property and/or pets of the Horse Owner ("Horse Nanny") or others offering or seeking services relating to horses as described on our website ("Subscription Services").

We grant you a non-exclusive, non-transferable right to use the Subscription Services and the information during the term of those services being the Initial Subscription Term together with any Renewal Periods. ("Subscription Term") solely for your personal use and information.

We shall use our reasonable endeavours to provide the Subscription Service 24/7 subject to any interruption including maintenance or circumstances outside our control.

The Subscription Service shall include online support services in accordance with our Support Services Policy made available on our website or on request by you.

Third Party Contracts

We assist you to make contact with third parties such as horse owners seeking a carer for their animal/s while away from the said property ("Horse Owners") or persons offering services of caring for the property and/or pets of the Horse Owner ("Horse Nanny") or others offering or seeking services relating to horses as described on our website.

We are not a party nor are we responsible for any contract you enter into with a third-party including but not limited to the contracts that Horse Owners enter into with a Horse Nanny ("Third Party Services").

For instance:

Where you enter into a contract for the care of your horse with a Horse Nanny you enter into a contract directly with that Horse Nanny. We are not a party to that contract and are not responsible for the service provided by that Horse Nanny. If the Horse Nanny is negligent causing injury to your horse or other damage or loss to you then your remedy is to claim against the Horse Nanny and not us. Therefore, we strongly advise you to exercise caution, use your own judgement as to the suitability of a Horse Nanny, consider any previous feedback, ask questions, review the website of Horse Nanny and make any other due diligence enquiries that appear to be appropriate.

we do not provide veterinary advice. Where a vet help service ("Vet Service") is referred to on our website you must enter into a contract directly with the Vet Service or use your own veterinary service.

We are not responsible for any loss arising from any Third Party Services provided to you or representations made, or advice given by third parties. We make no representation or give any warranty or indemnity regarding the quality of Third Party Services or the actions of third parties.

Fees for Service

Some promotional offers may not incur fees to use basic Horse Nannies services for specified period of the promotion.

Excluding the above mentioned promotional offers; You shall pay the Initial Subscription Fees to Horse Nannies International for the Member Subscriptions in advance and Subscription Fees for any Renewal Period shall be paid in full on each anniversary of Renewal Period.

Any fees or payments due to us are exclusive of tax (unless otherwise indicated) and may be increased at the start of a Renewal Period.

If fees due from you are unpaid we can deny access to you, suspend or cancel your subscription in our absolute discretion.

Posting Content

By posting content to the Website, unless otherwise agreed in writing you grant us a non-exclusive, world-wide, irrevocable and royalty-free licence to use any such content and to sub-licence same.

Any such content may be removed at our absolute discretion. No inappropriate material including but not limited to defamatory, obscene material or material which infringes third party rights shall be permitted. You will indemnity us for any liability, claim, damage, proceeding, loss, costs or expense we incur that arises from or which is directly or indirectly related to any such material posted by you or with your authority and/or your breach or non-observance of any term of these terms and conditions.

Unless otherwise terminated this agreement shall continue for the Subscription Term.

We may terminate this agreement if there is a material breach by you of a term of this agreement and you fail to remedy the breach within five (5) of notice of the breach.

On termination of this Agreement the accrued rights of the parties as at termination or the continuation after termination of any provision expressly stated to survive or implicitly surviving termination, shall not be affected or prejudiced.

No agency

No agency, partnership or joint venture relationship is intended or created between you and us.

Availability

This Website is not to be used by any person or entity in any jurisdiction or country where such use would be contrary to local law or regulation.

Variation

We reserve the right to amend these terms and conditions from time to time at our absolute discretion and notice to you of any such change shall be by us posting same at LINK

Any term or condition found to be unlawful or unenforceable shall be severed and will not affect the continued operation of the remaining terms and conditions.

Governing law

These terms and conditions are governed by and construed in accordance with the laws of Queensland, Australia and the jurisdiction of the courts of Queensland and of the Federal Court of Australia.
